Emergency Management Executive Orders
Executive Order 39 (Driscoll, 1954)
Designates the State Civilian Defense Director and the Office of State Civilian Defense Director as the State Agency responsible for coordinating federal and State assistance during natural disasters. (Note: these responsibilities were subsequently assigned to the New Jersey Office of Emergency Management pursuant to executive authority.)
Executive Order 12 (Cahill, 1970)
Requires State departments to develop and coordinate emergency plans and provide copies to and coordinate with the Director of the Division of Civil Defense and Disaster Control (subsequently transferred to the New Jersey Office of Emergency Management through executive authority).
Executive Order 101 (Byrne, 1980)
Established an Office of Emergency Management in the Division of State Police, Department of Law and Public Safety. The Office of Emergency Management shall be under the supervision, direction and control of the Superintendent of the New Jersey State Police, who will act as the State Director of the Office of Emergency Management.
Executive Order 161 (Kean, 1987) Implementation of The Federal Emergency Planning and Community Right-To-Know Act.
Implementation of the State Emergency Response Commission who shall perform all duties prescribed by the federal “SuperFund Amendments and Reauthorization Act of 1986”. Note: Modified and amplified by Executive Order 284 (Murphy, 2022).
Executive Order 115 (Florio, 1994) Establishment of the State Hazard Mitigation Team
Established an-Interagency State Hazard Mitigation Team Established an interagency State Hazard Mitigation Team. A representative of the office of the Governor will chair the team and the State Hazard Mitigation officer appointed by the Governor will serve as Deputy Chair. Lists other members of the team, their roles and responsibilities. Note: Subsequently modified and amplified by Executive Order 344 (Murphy, 2023).
Executive Order 248 (Murphy, 2021) National Incident Management System (NIMS)
Maintains NIMS as the State standard for response and mandates the State Director and NJOEM to a directive that includes the establishment of minimum requirements and qualifications for NIMS-compliant training for emergency response providers, other personnel, and government officials.
Executive Order 284 (Murphy, 2023) Compliance with the federal Emergency Planning and Community Right-to-Know Act
Amends and clarifies Executive Order 161 for the implementation of the Emergency Planning and Community Right-to-Know Act (EPCRA) in New Jersey. EO 284 adds NJOHSP to the State Emergency Response Commission (SERC), authorizes the SERC to designate emergency planning districts, provides review of homeland security concerns, and clarifies LEPC requirements.
Executive Order 344 (Murphy, 2023)
Amplifies and modifies EO 161 (Florio, 1994) regarding the composition and responsibilities of the State Hazard Mitigation Team.
